FORECLOSURE

SHORT SALES

When your mortgage loan(s) exceed the value of your home, sometimes the best solution may be to conduct a “Short Sale”.  A short sale is where you sell your home to a prospective buyer and negotiate with your bank to release the mortgage liens so that you can conclude the sale. 

 

A short sale conducted properly can allow the homeowner to resolve a difficult situation with dignity and will appear just like a traditional sale – you will be represented by a realtor, a “For Sale” sign can be posted in your yard, and you can shake hands with the new owner as you hand them the keys.  The difficult part of conducting a short sale is negotiating with your lender to release your mortgage liens.   A mortgage is one of the most substantial liabilities a person will ever have.  

 

It is important to take the proper steps to successfully navigate through a short sale to ensure the bank will forgive any remaining deficiency on the loan(s). At Jennings & Fulton, we have successfully negotiated hundreds of short sales for clients and can do all the heavy lifting for you.

LOAN MODIFICATION

A loan modification may help you avoid foreclosure, reduce your interest rate, obtain a fixed rate loan, avoid bankruptcy, and reduce your monthly payments.  Loan modifications are not for everyone, but under the right circumstances a loan modification may be just what is required for a homeowner to save their home. 

 

There are government and internal loan modification programs available that can provide relief for primary residences, second homes, and even investment properties. Litigation

Contract Drafting/Negotiating

Construction contracts dictate the obligations of every construction project.  From complex commercial construction contracts to simple tenant improvement or home modification contracts our attorneys have years of experience in assisting clients prepare and negotiate these contracts.  Our attorneys have drafted contracts for commercial construction projects that are worth tens of millions of dollars.  Use of the AIA contract is usually recommended and used for commercial projects.  At Jennings & Fulton, our attorneys have years of experience negotiating and drafting these construction contracts.
