Real Estate

Contracts

Contracts are the base of every real estate transaction. It is important from day one of your real estate transaction to properly document your purchase, sale or lease of real estate. At Jennings & Fulton, we offer transaction and contract drafting services for all real estate matters including: purchase and sale agreements, financing, deeds of trust, promissory notes, loan agreements, loan modifications, construction contracts, covenants, conditions and restrictions (CC&Rs), and foreclosure.

A well drafted contract helps avoid litigation. Our attorneys draw experience not only from our extensive real estate experience but also from corporate, construction, and other commercial transactions. We have represented builders, lenders, developers, property owners, contractors, and other parties involved in real estate transactions. We are familiar with all of the potential issues, objectives, and outcomes of all parties involved.  In addition, our experience in the court room and how these contracts are litigated gives us a unique perspective that is utilized when drafting contracts for our clients.

Litigation

Our attorneys have years of trial experience dealing with real estate matters including: construction, loan/financing litigation, contract disputes, landlord/tenant disputes, title disputes, and adverse possession. Our reputation as litigators often provides our clients with more favorable pre-trial resolution results. Regardless of the path your case takes, we work efficiently and vigorously to get positive results at every level of your case.

Foreclosure

Losing a home can be one of the most traumatic experiences a person can go through and it is only amplified when children are involved.  The stress of losing a job, having to find a new place to live, and possibly parting with many personal possessions along the way can make it seem like there is no hope. The State of Nevada has passed several laws that offer distressed homeowners protection if foreclosure appears likely.  At Jennings & Fulton, we are sensitive to this situation and can help you protect your rights and guide you through the process.  Don’t be intimidated by the banks.  Know your rights and protect your financial assets.

Short Sales

When your mortgage loan(s) exceed the value of your home, sometimes the best solution may be to conduct a “Short Sale”.  A short sale is where you sell your home to a prospective buyer and negotiate with your bank to release the mortgage liens so that you can conclude the sale.  A short sale conducted properly can allow the homeowner to resolve a difficult situation with dignity and will appear just like a traditional sale – you will be represented by a realtor, a “For Sale” sign can be posted in your yard, and you can shake hands with the new owner as you hand them the keys.  The difficult part of conducting a short sale is negotiating with your lender to release your mortgage liens.   A mortgage is one of the most substantial liabilities a person will ever have.  It is important to take the proper steps to successfully navigate through a short sale to ensure the bank will forgive any remaining deficiency on the loan(s). At Jennings & Fulton, we have successfully negotiated hundreds of short sales for clients and can do all the heavy lifting for you.

Loan Modification

A loan modification may help you avoid foreclosure, reduce your interest rate, obtain a fixed rate loan, avoid bankruptcy, and reduce your monthly payments.  Loan modifications are not for everyone, but under the right circumstances a loan modification may be just what is required for a homeowner to save their home.  There are government and internal loan modification programs available that can provide relief for primary residences, second homes, and even investment properties. At Jennings & Fulton, we have successfully negotiated a large number of complex loan modifications and have a support staff with extensive experience in the lending and banking industry.  Contact us to see if a loan modification may be available and the right option for you.

Landlord/Tenant

Landlord-tenant disputes can be very urgent and sensitive matters. Our attorneys are prepared to handle a wide variety of landlord-tenant disputes. We represent landlords and tenants.  We have experienced attorneys ready to help you through complex statutory issues that govern the relationship between landlord and tenant.  Areas of landlord-tenant law our office can help you with include: drafting lease agreements, breach of lease, evictions, and protecting tenants’ rights related to single family homes, apartment communities, commercial properties, mobile homes, RV’s and more.
